- Terms and Conditions
All bookings accepted by Flat Crest Motorsport Travel (‘FCMST’) are subject to these Terms & Conditions of Business which apply to the contract between FCMST and the Client.
- Contracts
1.1 The Contract is between FCMST and the person(s) making the booking (‘The Client’) which expression includes all persons on whose behalf the booking is made. Their liability to FCMST is joint and several.
1.2 No contract shall exist until a booking form has been received by FCMST with payment of the booking deposit or the full amount of the booking as required by FCMST unless the booking is made through our website in which case the contract shall consist upon payment of the booking deposit.
1.3 Telephoned bookings must be confirmed in writing.
1.4 FCMST will issue to the Client written confirmation of the booking but The Client must check carefully the written confirmation & report any error or omission immediately upon receipt of the confirmation.
1.5 No alteration to these Terms & Conditions may be made except in writing & signed on behalf of FCMST.
1.6 FCMST is an event management service arranging for The Client accommodation and travel to events connected with Motorsport. FCMST is not an organiser of these events. Responsibility for the events, the accommodation and the transport is with the organisers who are independent & separate from FCMST.
- Payment
2.1 Full payment in euro, less any deposit pre-paid shall reach FCMST no later that the Payment Date stated on the booking confirmation form. If Payment is not made on or before the Payment Date FCMST reserves the right to cancel the booking.
2.2 The Client is responsible for payment being made in full for all persons stated on the booking form (or any written variation of the form).
2.3 If you decide to cancel your booking or if payment is not made as required and FCMST exercise it’s right to cancel the booking, FCMST may make a cancellation charge, calculated as follows:-
– where Notification is given prior to the Payment Date stated on the booking confirmation form the deposit will be retained;
– where Notification is given on or after the Payment Date stated in the booking confirmation form the cancellation fee shall be equal to the full price.
- Prices
3.1 All prices are quoted in euro.
3.2 FCMST reserves the right to increase/reduce advertised prices before the booking is accepted. The correct price will be notified on the booking form at the time of acceptance of the booking.
3.3 If the Client wishes to cancel or change the booking because of the above FCMST will endeavour to accommodate the change BUT any changes within 16 weeks of the departure date stated on the booking form will be treated as a cancellation.
- Alterations
4.1 As bookings are (often) made many months in advance of the departure date changes or event cancellation can occur. FCMST reserves the right to make alterations to details before and after bookings are accepted.
4.2 FCMST will advise of changes as soon as possible.
4.3 FCMST will not be liable for compensation or a refund of the booking cost for minor changes but for major changes:
(a) The Client will have a choice to accept the change(s);
(b) The Client may purchase another trip from FCMST & pay or receive any price difference (Flights not included);
4.4 FCMST reserves the right to cancel The Client’s booking in any circumstances and all our bookings operate subject to a minimum number of participants.
4.5 FCMST will not cancel a booking less than 16 weeks before the departure date except by reason of force majeure or because The Client has not paid the final invoice.
(a) Any event cancelled by force majeure no more than 7 days before departure will be refunded for all monied paid to FCMST.
(b) Any event cancelled less than 7 days before departure will receive credit towards another event for all monies paid to FCMST.
(c) FCMST will not be liable for any event cancelled after/during departure date.
- Insurance & Injury
5.1 It is a condition of a booking being accepted that The Client will provide a suitable travel insurance policy for the trip, and take care to ensure that it does cover all the activities that are part of the trip.
5.2 FCMST cannot accept responsibility for injuries or loss caused to The Client through an occurrence that happened when the Client was spectating at a motor rally, whether that rally was for the purpose of driving motor vehicles at competitive speed or otherwise. The Client must use their own care & attention when spectating. The Client must therefore spectate at a motor rally at the Clients own risk.
5.3 FCMST has no responsibility for death, bodily injury & illness where that is caused by a third party not connected with the booking &/or where FCMST could not have foreseen or forestalled the occurrence giving rise to the death, bodily injury or illness.
5.4 FCMST shall have no liability for loss/damage to luggage or personal belongings (including money) as The Client is required to obtain minimum insurance cover for these before departure date.
5.5 The Client must ensure that appropriate clothing and footwear for spectating at the motor rally events taking into account the time of year and climate of the country where the motor rally event is held. FCMST accepts no responsibility for injury or loss incurred by the client due to inappropriate clothing or footwear.
- Travel Delays
FCMST will not be liable for loss that occurs from The Client arriving late or being delayed at any airport or seaport or any road or railway.
- Valid Documents
The Client is responsible for obtaining all valid documents necessary for international travel before the departure date such as passport(s), visa(s), vaccination certificate(s) & other health certificate(s).
- Disability
FCMST will use best endeavours to make arrangements for people suffering from disability (physical or mental) or other problems of fitness or health but FCMST cannot be responsible for the policy or the acts/omissions of suppliers of accommodation& transport services.
- Brochure Information
9.1 The information contained within the online brochure is correct to best of our knowledge at the time of the brochure going online. However, the client should bear in mind that in relation to the information given about the resorts and certain of the facilities we cannot guarantee accuracy at all times or that any particular activity will take place as these services are not under our control.
9.2 The information provided by FCMST to the client about the motor rally event including but not limited to the directions to and from the various locations where the motor rally event is taking place are merely guidance. Although FCMST takes all reasonable precautions to ensure the information is correct at the time it is printed FCMST cannot be held responsible for any errors or omissions which are outside its control.
- Behaviour by The Client
10.1 The cost of damage & breakages will be charged to The Client& must be paid before the end of event. The Client undertakes to behave & not to cause inconvenience to others or harm the reputation of FCMST or those providing services to The Client or to FCMST.
10.2 FCMST reserves the right to enforce The Client’s undertaking & claim from The Client re-imbursement of all losses & costs incurred as a result of The Clients failure to honour the Undertaking.
- Accommodation
The Accommodation provided is only for the use of clients shown on the booking form & therefore subletting is prohibited. Rooms within our accommodation are for the use of clients on the booking form only but facilities may be shared between other FCMST guests.
